AGENTVIEW — TERMS OF USE

1. Use of the Platform

1.1 License Grant

Subject to these Terms, AgentView grants you a limited, non-exclusive, non-transferable license to access and use the Platform to manage insurance-related client information, tasks, and workflows.

1.2 Eligibility

You must be at least 18 years old and legally able to enter contracts.

1.3 Account Responsibility

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all actions taken using your account.
• You must promptly notify us of any unauthorized use.

1.4 Cookie Notice Requirements

If you reside in a region that requires cookie notices or cookie consent mechanisms under applicable law, you must not use this system or site. By accessing or using the Platform, you represent that you are not subject to any jurisdiction that requires such cookie notices or consent mechanisms.

2. User Obligations & Acceptable Use

You agree not to:

• Use the Platform for unlawful, fraudulent, or unauthorized purposes.
• Upload, store, or transmit malware, harmful code, or automated scraping tools.
• Attempt to access or manipulate data that does not belong to you.
• Copy, distribute, reverse engineer, or create derivative works of the Platform.
• Use the Platform to harass, spam, or harm others.

3. User Data & Client Information

3.1 Ownership

You retain ownership and responsibility for all client information, business records, and other content you upload ("User Data").

3.2 License to AgentView

You grant AgentView a limited license to store, process, transmit, and back up User Data solely for the purpose of providing Platform functionality.

3.3 Representations

You represent that you have the legal right to upload and manage User Data, including applicable client consent where required.

4. Intellectual Property

The Platform, including its design, code, features, logos, trademarks, and content, is owned exclusively by AgentView. You may not reproduce, distribute, or create derivative works without explicit written consent.

5. Payment & Subscription Terms

If you subscribe to paid services:

• Fees are billed as stated on your Agency subscription page.
• Paid subscriptions renew automatically unless canceled as specified.
• Failure to pay may result in suspension or termination of access.

6. Third-Party Services

The Platform may integrate with third-party software or data services. AgentView is not responsible for those third parties, whose own Terms and Privacy Policies apply.

7. Disclaimer of Warranties

To the maximum extent permitted by law:

• The Platform is provided "as-is" and "as available."
• We make no warranties about uptime, accuracy, or fitness for a particular purpose.
• We do not guarantee error-free or uninterrupted service.

8. Limitation of Liability

To the fullest extent permitted by law, AgentView is not liable for:

• Any indirect, punitive, special, consequential, or incidental damages.
• Any data loss, business interruption, or financial losses.
• Any unauthorized access resulting from User error or negligence.

9. Indemnification

You agree to indemnify and hold AgentView harmless from claims, damages, and expenses arising from:

• Your misuse of the Platform
• Your violation of these Terms
• Your violation of others' rights or applicable laws

10. Termination

We may suspend or terminate your account for violating these Terms.

You may stop using the Platform at any time.

Upon termination:

• Your license to access the Platform ends
• We may delete your account and associated data as permitted by law

11. Modifications

We may update these Terms from time to time. Updates will be posted here and may require re-acceptance upon login.

12. Governing Law

These Terms are governed by the laws of the State of Ohio.
